Wife of a Chinese couple. They have been living in Japan for 8 years.
Her husband has found a new girlfriend and currently asking his wife to divorce him. Our client does not want to divorce him, but later on if they do decide to, she would like to know if foreigners could get divorces in Japan.
As long as the couples are the same nationality, and both of them are currently living in Japan, yes they can get a divorce in Japan, under the Japanese law.
If the couple agrees on the divorce, they can get a uncontested divorce, just by handing in documents at the municipal office, along with proof that uncontested divorce is leagal in their mother country also. Another way of getting a divorce in Japan is getting a divorce mediation at the family court. Also you can go to the nearest district court to get a contested divorce.
In our client’s case uncontested divorce is legal in China, so they are eligible in getting a mutual agreed divorce in Japan.
